AN Enugu High Court presided by R.O. Udugu on Monday extended its ex-parte order restraining Senator Ayogu Eze from parading himself as the governorship candidate of the Peoples Democratic Party (PDP) in the state.
The order also bars the PDP from recognizing or submitting any name other than that of Ifeanyi Ugwuanyi as its governorship candidate for the state.
The court adjourned the case to December 22 for further hearing.
At the resumed hearing of the case on Monday, Ugwuanyi’s counsel, Mr. Ogochukwu Onyekwuluje, brought a motion on notice for interlocutory injunction against the defendants.
He said he had served all the processes to the 2nd defendant (PDP) but had not been able to serve the 1st defendant, Senator Eze. Therefore, he moved a motion for substituted service of the writ of summons and all other processes in the suit on the 1st defendant by substituted means.
According to reports, court okayed the application that the processes be served on Eze by pasting it on the front entrance gate of his residence at No.1, Ayogu Eze Close, Independence Layout, Enugu.
Udugu granted Onyekwuluje’s oral application for the extension of the duration of the ex-parte order, which was not opposed by the PDP counsel.
The court further ordered that a fresh copy of the order should be drawn upon and enrolled for service on the Eze and thereafter adjourned the matter to December 22 for hearing of the substantive application by either the regular court or vacation court, as the case may be, subject to the appropriate service of the processes on Eze.
