Lagos—The President of the Christian Association of Nigeria, Ayo Oritsejafor has dragged the Lagos State Government along side six others to court before Justice Deborah Oluwayemi, of a Lagos High Court sitting at Tafawa Balewa Square, TBS, over an alleged intention to demolish his Church, situated at Plot 21e, Abdulrahman Okene Close, Off Ligali Ayorinde Street Victoria Island Annex, Lagos.
The property in contention through Hajiya Aisha Mata Abdrrahman with Certificate of Occupancy No. 68/68/199AR dated 23 November, 1991, was bought by the Church from Habib Nigeria Bank Limited by virtue of Deep of Legal Mortgage No. 11/11/1961 dated September 27, 1994 and Deep of Assignment No 34/34/2081 of the Register of Deep kept at the Lagos state Land Registry, Lagos, which is also known as the address above.
After the purchase of the property, the claimant took immediate and undisturbed possession of the land and it commenced building without any disturbance from the defendants, the claimant then applied to the defendants and secured an approval for a charge of use of land from residential to institutional (place of worship) vide letter dated September 7, 2004.
The claimant commenced on the building of its church and at the same time applied for building plan approval, which was then being processed by the defendants. The claimant’s application for building plan approval was received processed and assessed for payment of various sums of money which the claimant promptly paid.
