The National Judicial Council is set to probe Justice Adeniyi Ademola of a Federal High Court in Abuja over his judgment which sacked the Acting Governor of Adamawa State, Umar Fintiri, and installed Bala Ngilari as the substantive governor.
It was learnt on Tuesday that a former Attorney General of the Federation and Minister of Justice, Mr. Bayo Ojo (SAN), had on behalf of Fintiri, petitioned the NJC, alleging that Justice Ademola frustrated his appeal against the judgment.
He alleged in the petition, signed by a lawyer in his law firm, Mr. Duro Adeyele (SAN), that Justice Ademola deliberately held back the Certified True Copy of the judgment, denying him the opportunity of concretising his appeal against the judgment.
The judgment was delivered on October 8, while the two petitions on the issue which were addressed to the Chief Justice of Nigeria, Justice Aloma Mukhtar, as the NJC chairman were dated October 10 and October 14.
One of the petitions read in part, “To begin with, though Tuesday 7th October was a public holiday, I got a phone call at about 6:19 pm from someone who claimed to be the secretary to the presiding judge of Federal High Court No 6, Abuja intimating me that judment in the above quoted suit would be delivered the next day Wednesday 8th October.ment was not ready for certification as it was still being typed.”
